Expanding Gambling Restrictions

Florida lawmakers introduced two bills aimed at expanding the state’s ban on gambling, potentially affecting both consumers and providers of online gaming platforms. The bills, HB953 and S1404, seek to broaden Florida’s gambling laws by restricting internet casino gaming, online sports betting, and the controversial sweepstakes casinos. This legislation could have significant implications for Florida's booming gaming industry, especially regarding the scope of the state’s compact with the Seminole Tribe.

On February 24, Representative Walter Barnaby filed House Bill 953, which was followed by Senator Corey Simon’s companion bill, Senate Bill 1404, filed two days later. The proposed legislation explicitly extends the ban on “internet gambling” and “internet sports wagering,” both of which could affect the rapidly expanding world of online casinos and digital sports betting outside the scope of Florida's agreement with the Seminole Tribe. The Seminole Tribe's agreement allows its Hard Rock operation to offer online sports betting, but these bills could create new limitations.

The Shift in Florida's Gambling Landscape

At the heart of the proposed bills lies a broader attempt to curb the growth of internet-based gaming operations that have emerged in the wake of Florida’s expanding gambling framework. In May 2021, the state entered into a 30-year compact with the Seminole Tribe, which permitted the Tribe to operate mobile sports betting and expand its gaming operations. This compact, which was valued at an estimated $500 million annually, survived legal challenges at both the state and federal levels and ushered in a new era of gaming in Florida.

However, the bills introduced this week could restrict the expansion of online gaming even further, particularly targeting platforms that offer “sweepstakes casinos.” These online platforms allow users to engage in casino-style games, like slots and poker, using credits or “sweepstakes entries,” which can eventually be exchanged for cash prizes. On the other hand, the definition of “internet sports wagering” seems less complex, as it directly refers to betting on the outcome of various contests of skill or speed—activities that Florida has already legalized in partnership with the Seminole Tribe. This includes online sports betting, which Hard Rock began offering in December 2023 under the expanded compact. With the new bills, lawmakers would make it illegal to place wagers on sports via the internet outside the framework of the existing deal with the Tribe.

Penalties for Players and Providers

If the bills pass, Florida could impose significant penalties on both players and operators of these online gaming platforms. Those caught engaging in internet gambling could face second-degree misdemeanor charges. Notably, it would take two offenses for an individual involved in internet sports betting to reach the threshold for criminal penalties. This nuance could complicate enforcement and ensure that individuals are repeatedly violating the law before facing criminal consequences.

For providers, the situation could be more severe. Operators of internet gambling sites, including those offering sweepstakes casino games or unauthorized sports betting platforms, could face stiff penalties.
