Florida Seminoles and West Flagler Settle Sports Betting Dispute

the Seminole Tribe and West Flagler, owners of two Florida parimutuels, have reached a settlement following a lengthy legal battle over sports betting regulations. This announcement comes four months after the U.S. Supreme Court declined to hear West Flagler’s case against the U.S. Department of Justice. That decision effectively upheld an appellate court ruling, which legalized digital sports betting for the Seminoles throughout Florida. The settlement not only resolves ongoing litigation but also sets the stage for a new chapter in Florida’s gaming industry.

The agreement marks a dramatic shift for both parties, especially for West Flagler, which had invested three years and significant financial resources in legal challenges aimed at invalidating the 2021 compact between the state and the Seminoles. Bob Jarvis, a constitutional law professor at NOVA Southeastern, noted that despite the extensive litigation, West Flagler had little chance of success from the beginning. “One wonders why West Flagler was so pig-headed,” Jarvis said, questioning the advice that guided their costly legal strategy. By settling, both sides can now focus on future opportunities rather than the protracted legal disputes that defined their recent history.

Under the terms of the new agreement, the Seminoles can fully implement their plans for sports betting, with implications for the future of online gambling in Florida. The compact permits bets to be considered placed wherever they are received, meaning that wagers made in Florida through servers located in Indian Country are legal. While the current agreement does not specifically authorize online casinos, it opens the door for potential future developments.

Jarvis anticipates that the Seminoles will soon negotiate for full mobile betting rights. As commercial operators seek to enter Florida's market, they face significant revenue-sharing requirements, as they must pay the Seminoles 60% of their gross gaming revenue if they wish to partner with the Tribe. This dynamic raises questions about the viability of such partnerships, given the high costs involved.
