Massachusetts lawmakers have days to act on three online casino bills before they expire — and duelling polls, casino operator opposition, and public health concerns are making that decision anything but straightforward.

With legislative deadlines bearing down, the future of iGaming in Massachusetts hangs in the balance. Three separate bills — H332, S235, and H4431 — must clear committee votes before March 16 and 18, 2026, respectively, or they will expire entirely, pushing any prospect of a regulated online casino market in the Bay State well beyond the current legislative session.

Three bills, one shrinking window

The legislative scramble around Massachusetts iGaming is not new, but the urgency is. Companion bills S235 and H332, sponsored by Senator Paul Feeney and Representative Daniel Cahill respectively, have been working through the legislative process since last year. A third measure, H4431, filed by Representative David Muradian in January, would take a different approach — legalising and regulating online casino games while simultaneously imposing an outright ban on sweepstakes gambling platforms.

The Feeney-Cahill framework would allow each of Massachusetts' three brick-and-mortar casinos — Encore Boston Harbor, MGM Springfield, and Plainridge Park Casino — to partner with up to two online operators, while also granting the Massachusetts Gaming Commission authority to issue up to four additional untethered licences. The proposed tax rate sits at 20% on gross gaming revenues, with five-year licences and an annual fee of $1 million. Muradian's H4431 takes a tighter approach, capping the tax at 15% and restricting licences strictly to existing casino operators.

All three bills received committee reporting extensions earlier this year, a procedural step indicating lawmakers were not yet ready to issue formal recommendations. That extended runway is now nearly exhausted.

The polling picture is anything but clear

If Massachusetts legislators were hoping the public would provide a decisive mandate, two competing surveys have instead muddied the waters considerably. A Beacon Research poll commissioned by the Sports Betting Alliance, conducted in late January 2026 among 1,000 registered voters, found that 59% of respondents supported legalising iGaming, compared with just 24% in opposition. The survey reported bipartisan backing, with 69% of Republicans, 58% of Democrats, and 56% of independents in favour.

However, a separate Emerson College survey reached a near-opposite conclusion, finding that 56% of Massachusetts residents opposed legalisation, with just 28% in support. The divergence almost certainly reflects how the question was framed: when iGaming is presented as a tool to curtail illegal offshore gambling and generate state revenue, support approaches 60%. When presented as round-the-clock smartphone access to casino-style games, opposition exceeds 50%.

Opposition from an unlikely corner

Perhaps the most significant friction in the iGaming debate has come not from anti-gambling advocacy groups, but from within the industry itself. Encore Boston Harbor's parent company, Wynn Resorts, submitted a formal letter to the legislature opposing iGaming expansion, warning that mobile casino gaming carries greater addiction risk than in-person play. Encore's executive director of government relations, Eileen McAnneny, argued the legislation could cost nearly 1,800 casino employees their jobs through revenue cannibalism from the physical gaming floor.

PENN Entertainment, operator of Plainridge Park Casino, has taken a more nuanced position — supporting legalisation in principle, but insisting that all online licences remain tethered to existing brick-and-mortar operators. The company argues this structure would allow online growth without undermining the existing jobs base. Labour unions representing casino workers have been broadly aligned with Encore's position, raising the spectre of brick-and-mortar decline in testimony before the Joint Committee on Consumer Protection and Professional Licensure.

Public health advocates have added a separate layer of opposition. Mark Gottlieb of the Public Health Advocacy Institute at Northeastern University has pointed to rising problem gambling rates since the legalisation of sports betting in the state, with a UMass study showing the proportion of sports bettors experiencing gambling-related problems rising from 20.9% in 2022 to 28% by 2024. Andrea Freeman of the Public Health Institute of Western Massachusetts has cited increasing rates of underage gambling in local schools as further cause for caution.

The regional context and what comes next

Massachusetts does not exist in a regulatory vacuum. Neighbouring Connecticut has operated a regulated iGaming market since October 2021 and has generated over $233 million in tax revenue from it. Rhode Island launched its own online casino framework in March 2024. With only eight US states currently permitting internet-based casino gambling, Massachusetts finds itself in a position to join a small but rapidly developing group, or to watch the window close again for another legislative cycle.

The Massachusetts Gaming Commission has consistently indicated its readiness to regulate should legislation pass. Thomas Mills, a spokesperson for the MGC, told local media that the commission's position is clear: if residents choose to gamble, the preferred environment is under state oversight with licensed operators. The commission already manages sports betting under Chapter 23N and has been seen as competent and structured enough to absorb iGaming regulation.

H4431's additional provision — banning sweepstakes gambling platforms and imposing fines of up to $100,000 per offence for violations — has attracted attention as a signal that lawmakers are aware of the grey market already operating within the state's borders. Sponsors of all three bills have framed legalisation as a mechanism to bring existing online gambling behaviour into a regulated, taxed, and accountable structure.

As the March deadlines approach, Massachusetts stands at a crossroads that many US states before it have faced and navigated in different directions. Should any of the three bills advance, the Massachusetts Gaming Commission would be tasked with setting up licensing frameworks, approving operators, and establishing consumer safeguards — a process that, even under optimistic projections, would likely mean live platforms no earlier than 2027. For Massachusetts residents already accessing offshore or unregulated platforms, the question is not whether iGaming exists in the state, but whether it will be regulated, taxed, and consumer-protected when it does. The answer, for now, rests with a handful of committee members and a ticking clock.
