In a 25-page decision, U.S. District Judge John Ross found that the so-called “no-chance” machines—marketed by some vendors as games of skill—meet the statutory definition of gambling devices when operated outside licensed casinos. The ruling targets machines deployed in gas stations, restaurants, and convenience stores across the state.
Ross cited an October federal jury verdict ordering Torch Electronics to pay $500,000 after a competitor alleged the company had repeatedly represented its games as lawful. In his opinion, Ross wrote that Torch’s machines “meet the statutory definition of ‘gambling device’ and are therefore illegal under Missouri law when played outside a licensed casino.”
The decision reinforces a legal interpretation that could reshape Missouri’s gray-market gaming landscape. For years, the machines have proliferated in retail locations, generating revenue for small businesses and operators who argue the games differ from traditional slot machines because they incorporate elements of player interaction.
Enforcement efforts have accelerated under Missouri Attorney General Catherine Hanaway, whose office has filed lawsuits against retailers hosting the machines. Hanaway has also said her office is assisting a federal investigation examining potential money-laundering and banking issues tied to the devices. Torch has indicated it plans to appeal once remaining procedural matters are resolved.

Machines could be removed, operators may face civil penalties, and settlements could be enforced following the ruling. At the same time, the court decision lands as Missouri lawmakers debate legislation that would authorize a licensed, state-regulated video lottery network. Under the proposed framework, retail video lottery terminals would be required to return at least 80% of wagers to players. Roughly one-third of net proceeds would be directed to education funding, while a 3% tax would flow to local governments.
The bill also proposes a one-year wind-down period for unregulated operators, along with an annual per-machine fee earmarked for disability services. Supporters argue the legislation would shift gaming activity from a legally ambiguous environment into a regulated structure with defined consumer protections and dedicated public funding streams. Critics, however, contend that legalization could expand gambling access and normalize devices that courts have now explicitly deemed unlawful outside licensed casinos.
