Ukraine Shifts Course on Gambling Regulation

Ukraine has disbanded the Commission for the Regulation of Gambling and Lotteries (KRAIL), signaling a strategic realignment of its gambling oversight structure. President Volodymyr Zelenskyy's approval of Law No. 9256-d has set the stage for a new regulatory framework, with plans to establish a central authority by April. This move represents an effort to streamline oversight and address longstanding challenges within the country's gambling industry.

The forthcoming regulatory body will expand its mandate, assuming responsibilities that include live monitoring systems, player identification protocols, and measures to mitigate gambling-related harm. A particular emphasis will be placed on curbing access to unlicensed gambling platforms and addressing addiction among users. Operators will also face tighter restrictions on advertising, with a notable reduction in promotional activities, except for narrowly defined contexts such as late-night television slots and platforms aimed at older audiences.

This restructuring aims to centralize governance and strengthen oversight, positioning the government as the primary authority over gambling and lotteries.

KRAIL's dissolution follows a tumultuous tenure marked by allegations of corruption and mismanagement. Established as part of Ukraine's decision to legalize gambling in 2020, the regulator became embroiled in controversies that ultimately led to its downfall.

In 2021, the Anti-Corruption Bureau of Ukraine (NABU) apprehended a KRAIL official, Yehven Hetman, on charges of accepting substantial bribes in exchange for issuing gambling licenses without proper due diligence. Investigations revealed irregular license approvals for operators in certain regions, casting doubt on the integrity of the regulatory process.

More recently, the head of KRAIL, Ivan Rudyi, was detained for his alleged involvement in facilitating the operations of a Russian-affiliated online casino. This incident raised concerns about national security, as it was feared that Russian entities could gain access to sensitive personal data, including information about Ukrainian military personnel who used the platform.

The controversies surrounding KRAIL highlighted systemic vulnerabilities and underscored the urgent need for reform. President Zelenskyy's decision to dissolve the body reflects a broader effort to address these issues and establish a more credible governance structure.

This regulatory overhaul has substantial implications for Ukraine's gambling sector. The government aims to restore confidence and ensure compliance with higher standards by dissolving KRAIL and introducing a new centralized authority. However, the transition presents several challenges for operators and stakeholders.

The new authority's expanded mandate will likely increase the operational burden on gambling businesses. Enhanced monitoring requirements and stricter enforcement of responsible gambling measures, such as spending caps and playtime limits, may necessitate significant investments in compliance infrastructure.

At the same time, efforts to curtail unregulated gambling activities and enforce stricter advertising guidelines will reshape market dynamics. Operators may face reduced opportunities to reach potential customers, particularly as advertising avenues are scaled back. However, these measures also aim to protect users and promote a safer gambling environment, which could ultimately contribute to the sector's sustainability.
