Swedish Regulator Reviews Telephone Sales Practices
A regulatory review in Sweden has led to enforcement action against an online gambling operator after authorities determined that its telephone marketing procedures did not comply with national law. The country's gambling regulator, Spelinspektionen, has issued a formal warning and imposed a financial sanction of SEK 400,000 (roughly €37,500) on ImpactWin Partner Ltd. The decision followed an investigation into how the company concluded subscription agreements with customers during telephone calls.
The regulator concluded that the operator's method for confirming participation in certain lottery-style services did not meet the requirements set out in Sweden's gambling legislation. The issue did not concern the operation of the lottery products themselves but focused on how agreements were finalized after marketing calls.
Telephone contact has been one of the channels used to promote these subscriptions. According to the regulator's findings, company representatives contacted potential customers and presented offers during calls that could lead to the formation of a contract for gambling services. Such interactions fall under specific legal provisions governing distance sales.
Under these rules, when a gambling operator contacts an individual with the intention of offering a gambling contract, the company must follow a two-step procedure. First, the terms presented during the call must be confirmed in writing, in a format the consumer can read and retain. Second, the agreement becomes valid only after the consumer provides written acceptance of the offer following the conversation.
Spelinspektionen determined that ImpactWin Partner Ltd's procedures did not align with this framework. According to the authority, the operator confirmed gaming subscriptions and consumer approvals in a manner that did not comply with the written acceptance requirement following the telephone call. As a result, the regulator concluded that the company had breached the provisions governing telephone sales.
The relevant rule appears in Chapter 14, Section 19 of the Swedish Gambling Act. This provision specifically addresses the formation of gambling contracts through telephone marketing. It requires that offers made during such calls be confirmed in a durable, accessible written form, after which the consumer must explicitly accept the agreement in writing.
Alongside the financial penalty, Spelinspektionen issued a warning to the operator. Such warnings form part of the regulator's enforcement framework and signal that corrective measures must follow. Companies receiving such decisions are expected to review their internal procedures to ensure that future customer interactions comply with legal requirements.
The case also highlights the role of administrative procedures in gambling regulation. In many enforcement actions, regulators examine not only the products offered by operators but also the processes used to market those products and formalize agreements with customers. Compliance obligations, therefore, extend beyond game design or payment systems to include communication practices and documentation methods.
ImpactWin Partner Ltd, which previously operated under the name More Tech Group Ltd, will now need to adjust its procedures if it intends to continue offering subscription-based lottery services through telephone marketing. Revising the contract confirmation process so that written offers and written approvals are clearly documented is likely to form part of that adjustment.
